Terms & Conditions

These Terms & Conditions apply to bookings made for programmes offered through The Peak Snowsport Academy (“The Peak”).

By making a booking, you confirm that you have read and agreed to these Terms & Conditions and any additional terms applicable to your selected programme.

1. Parties and Roles

The Peak Snowsport Academy is operated by V.I Group Co., Ltd. (“V.I Group”), which is responsible for the local services and training provided by The Peak.

​

Beyond The Limited (“Beyond”) acts as the booking and payment partner for The Peak and is responsible for administering customer bookings, payments and related booking support.

​

For official CASI certification courses, JOI acts as the authorised CASI Course Provider responsible for arranging and delivering the applicable CASI course.

​

CASI (Canadian Association of Snowboard Instructors) is the certification body responsible for the applicable certification standards, requirements and certification outcomes.

​

Each party is responsible only for the services and functions within its respective role.

​

2. Bookings and Payments

  1. Bookings are subject to availability and any applicable minimum participation requirements.

  2. Payments for bookings may be collected and processed by Beyond The Limited as The Peak's booking and payment partner. Accordingly, Beyond The Limited or its applicable payment descriptor may appear on your payment record or card statement.

  3. A booking is not considered confirmed until the applicable booking requirements have been satisfied and confirmation has been issued.

  4. Customers are responsible for providing complete and accurate information when making a booking.

3. Minimum Participation

  1. Certain programmes require a minimum number of participants to proceed.

  2. Where a minimum number applies, your booking may initially remain pending until the required number of participants has been reached.

  3. Customers are advised not to make non-refundable travel arrangements until their programme has been confirmed.

  4. If the required minimum is not reached, customers will be informed of the available options, which may include an alternative session or refund of the applicable programme fees paid.

4. Programme Fees

  1. The applicable programme fee and payment schedule will be displayed or communicated during booking.

  2. Customers are responsible for reviewing what is included in their selected programme before completing their booking.

5. Cancellations, Changes and Refunds

6. The Peak Training

  1. Training provided directly through The Peak is delivered by V.I Group and its appointed trainers.

  2. Training content, schedules and arrangements may be adjusted where reasonably necessary for the operation of the programme.

  3. Participation in preparatory or training programmes does not guarantee successful completion of any subsequent certification or assessment.

7. CASI Certification Courses

  1. Official CASI certification courses are separate from The Peak's preparatory training.

  2. Where a programme includes an official CASI certification course, the course is provided through JOI as the applicable CASI Course Provider and is subject to applicable CASI and course-provider requirements.

  3. Certification standards, assessment criteria and certification decisions are determined in accordance with CASI requirements.

  4. Neither Beyond nor V.I Group can guarantee that a participant will successfully obtain a CASI certification.

  5. Participants are responsible for satisfying all applicable eligibility, membership, registration and course requirements.

8. Independent Organisations

  1. Beyond, V.I Group, JOI and CASI perform different roles in connection with the programmes.

  2. Except where expressly stated otherwise, no party assumes responsibility for the acts, omissions, decisions or obligations of another independent organisation.

  3. Any service, assessment, certification or other matter controlled by an independent organisation is subject to that organisation's applicable terms, policies and requirements.

9. Participant Responsibilities

  1. Participants are responsible for ensuring that they meet the eligibility, ability and other requirements applicable to their selected programme.

  2. Participants must provide accurate information and follow reasonable instructions and applicable rules communicated by The Peak, V.I Group, JOI, CASI or any relevant facility or service provider.

  3. Failure to satisfy applicable requirements may affect participation or certification eligibility and does not automatically entitle the participant to a refund.

10. Inherent Risks

  1. Snow sports and related training involve inherent risks. By participating, customers acknowledge and voluntarily accept the risks ordinarily associated with such activities.

  2. Participants are responsible for assessing their own ability, health and suitability to participate.

  3. All participants are required to maintain valid personal travel or other insurance that specifically covers snow sports for the entire duration of the programme.

  4. Participants are strongly recommended to obtain comprehensive insurance covering medical treatment, accidents, personal liability, trip interruption or cancellation, and emergency medical evacuation and repatriation to their home country, including medically necessary air transportation where applicable.

  5. Participants are responsible for confirming that their insurance provides adequate coverage for the activities undertaken during the programme.

  6. The Peak, V.I Group and Beyond The Limited do not provide personal insurance for participants and are not responsible for any costs that would otherwise have been covered by appropriate personal insurance.

11. Third-Party Services

  1. Where any part of a programme involves services provided by an independent third party, those services may be subject to the terms, policies and requirements of that provider.

  2. Beyond and V.I Group are not responsible for the acts, omissions, performance or decisions of independent third parties, except to the extent that responsibility cannot lawfully be excluded.

12. Programme Changes

  1. Reasonable changes may be made to programme schedules, training arrangements, personnel or other operational details where necessary.

  2. Where a material change affects a confirmed booking, participants will be informed as soon as reasonably practicable and any available options will be communicated.

​

13. Personal Information

  1. Personal information provided in connection with a booking may be shared with V.I Group, Beyond, JOI, CASI and other relevant service providers where reasonably necessary to administer the booking, deliver the programme or process certification.

  2. Personal information will otherwise be handled in accordance with applicable privacy requirements.

​

14. Intellectual Property

  1. The Peak name, branding, website content and programme materials may not be reproduced or used for commercial purposes without the permission of the relevant rights holder.

  2. CASI names, trademarks, certification materials and intellectual property remain the property of CASI or their respective rights holders.

​

15. Limitation of Responsibility

  1. Each organisation involved in a programme is responsible for the services and obligations falling within its respective role.

  2. To the fullest extent permitted by applicable law, Beyond's responsibility is limited to the booking, payment and customer administration services undertaken by Beyond and does not extend to the delivery of local training, sporting activities, assessment or certification.

  3. To the fullest extent permitted by applicable law, V.I Group is not responsible for certification decisions or other matters controlled by JOI or CASI.

  4. Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted.

16. Additional Terms

  1. Individual programmes may be subject to additional booking conditions, eligibility requirements, cancellation policies or terms issued by The Peak, V.I Group, JOI or CASI.

  2. Where additional terms apply, they form part of the conditions applicable to the relevant programme.
